Submit a Claim - Claim Instructions

If you used a credit or debit card to make a purchase at an affected Dickey’s Barbecue Pit® location (“Dickey’s”) at any time during the Security Incident Period of April 23, 2019, to October 29, 2020, (“Security Incident”) then you can make a claim for settlement relief. You may receive monetary reimbursement, a lump-sum cash payment, or credit monitoring services if you fill out this Claim Form, if the Settlement is approved, and if you are found to be eligible for a benefit. Claim Forms must be submitted online or postmarked no later than April 22, 2023. Claims submitted after the deadline will be deemed untimely and may not be accepted.

Only one Settlement Claim may be submitted per Settlement Class Member, and only one Settlement Claim may be submitted per credit or debit card.


Documentation:

Upload Documentation must be provided to support your claim if you choose to make a claim for Out-of-Pocket Expenses. Supporting documentation must be sufficient enough to show (a) the amount of loss that you suffered, and (b) that the loss is reasonably attributable to the data breaches in the case. This documentation may include credit card or bank statements, emails, invoices, receipts, or telephone records, including photographs of the same. Personal statements or declarations are not reasonable documentation under the Settlement, but they may be used to provide clarification, context, or support for other documentation submitted in support of a claim.

It is important for you to upload or enclose documents that show what happened and what actions you took that caused the Out-of-Pocket Expenses.

If you are filing online, please have this information ready before you start to file, as your claim will not be saved if you have to come back and finish at a later time. Documents that are uploaded must be less than 20 MB per file and in one of these formats: jpg, jpeg, png, gif, tif, tiff, doc, docx, xls, xlsx, pdf, txt, rtf, or zip. If you are unable to electronically upload a copy of your documents as part of the online Claim Form, you will need to mail a printed Claim Form along with your documentation to the Notice and Claims Administrator.

Documents should be clear, readable copies, as anything you submit will not be returned to you.

After submitting your completed claim online, you will receive an email with a Confirmation Code for your completed submission. Receipt of a Confirmation Code means your claim was successfully submitted. If additional information is required to complete your claim, you will be contacted by the Notice and Claims Administrator.

If you wish to submit a claim via standard mail, you may download a copy of the Claim Form here. You will need to provide all of the information requested on the Claim Form, attach any supporting documentation, sign it, and date it. Then, mail it to the following address:
